2. Description of Service

UptimeDuty is an uptime monitoring tool that checks the availability of user-defined URLs and notifies users of downtime. We reserve the right to modify or discontinue the Service at any time.

3. User Responsibilities

• You are responsible for maintaining the security of your account and password.
• You must not use the Service for any illegal or unauthorized purpose.
• You agree not to monitor sites that you do not have permission to monitor.
• You must not attempt to interfere with the proper working of the Service.

4. Abuse and Fair Use

We reserve the right to limit or terminate your access if we determine, in our sole discretion, that your usage is abusive or exceeds reasonable "fair use" limits. This includes attempting to monitor an excessive number of targets at high frequencies on free tiers.

5. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED. IN NO EVENT SHALL UPTIMEDUTY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

6. Indemnification

You agree to indemnify and hold harmless UptimeDuty and its affiliates from any claims, damages, or expenses arising from your use of the Service or your violation of these Terms.

7. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.
